Thomas Burger was crossing the road when he came into the path of a silver Lexus sedan. The sedan was traveling northbound on the I-95. The collision between the sedan and the pedestrian occurred close to the northbound transition ramp of the road. It isn’t clear exactly why Burger was on the roadway at the time.
Following the collision, Burger sustained critical injuries. Once the paramedics and law enforcement personnel arrived on the scene of the accident, attempts to revive him failed. He was pronounced dead on the scene of the crash.
Nevada Highway Patrol and the Clark County authorities continue to investigate the incident. The focus of the investigations at this point is to determine how it occurred and which of the two parties was liable. From the facts available so far, it can be surmised that the driver may not be held liable as Burger was on the roadway, crossing at an undesignated area.
Once the NHP concludes its investigations, the liability in this case will be confirmed. Subsequent accident reports may also reveal the identity of the other driver.
