Agents with the Texas Alcoholic Beverage Commission arrested 31-year-old Raphael Medina on March 10 in connection with the intoxication manslaughter charge that 24-year old Paul Joseph Garcia is facing.
The TABC is charging Medina with serving alcohol to an already intoxicated person. Medina was the bartender working on the night of February 15 at Polvo’s Mexican Restaurant on Nueces Street. The restaurant is located in downtown Austin.

According to agents, the investigation showed that Garcia was already showing signs of intoxication when he was served.
Garcia is associated with the accident that involved a 55-year-old pedestrian named Lee Martin Cagle. Garcia had been driving without his headlights on and at an excessive rate of speed that he hit Cagle while driving near Slaughter Lane and Menchaca Road.
After hitting Cagle, he proceeded to drive a distance of at least a half of a mile to the South Austin Beer Garden with the corpse of Cagle in the passenger seat.
It was witnesses to the condition that Garcia was in at the Beer Garden who called the authorities. There was a string of evidence from the site of the accident to Garcia’s car.
Garcia was charged with intoxication manslaughter and accident involving injury. He has remained in the Travis County Correctional Complex with a bail set at $110,000.
Medina was taken to Travis County Jail with a bail of $2,500 but he was released on bond the same day as his arrest.
There has been no statement made by the restaurant regarding the accident or the charges.
The TABC stated that they are still actively investigating the accident.
