They soon discovered that the Aviles, who caused the crash, had fled the scene on foot, and a short chase began. While the latter was ongoing, the suspect threw a gun away. The officers captured him a few blocks away from the accident scene and effected an arrest.
The injured persons, identified as a female driver and a child, were taken to the hospital for treatment, and their condition is unknown at this time. Padilla said that they booked Aviles on suspicion of DUI, and unlawful possession of a firearm, and high capacity magazine.
The police did not state why a hit-and-run charge was not included. The investigation into the accident is ongoing, and anyone with relevant information should contact the PPD.
A hit-and-run is a severe offense in the state of California that prosecutors try as a misdemeanor of a felony. A conviction means a prison sentence, a fine, or both. Those involved in this kind of accident should contact a car accident lawyer for legal advice and representation.
