The police said that Banos was using his cellphone while driving a white pickup truck. A man identified as Felix Mayer, 57, was heading north on his bicycle when the suspect struck him from behind. The man died from his injuries, and the medics pronounced him at the scene.
Banos didn’t stop to render assistance, fleeing the scene instead. Ortega said that the police didn’t locate him until Saturday morning after spotting him near Hope and Roswell Roads. They collected the suspect’s car as evidence and booked him without bond into the Fulton County Jail.
The man is facing charges of distracted driving, first-degree vehicular homicide, felony hit-and-run, reckless driving, and failure to maintain lane. The police might add additional charges pending the outcome of their investigation.
Making calls or texting while driving are the most common forms of distracted driving. It takes only three seconds for a distracted driver to crash, and it often involves a collision with other road users.
Those involved in bicycle accidents caused by distracted driving should hire a bicycle accident attorney for legal advice and representation.
