The man who caused an accident while under the influence of alcohol in West Tawakoni, Texas, is in the custody of the Department of Public Safety. Officers with the agency arrested Hershel Fain, 63, of Quinlan, on Tuesday, June 16th, and he would need a drunk driving attorney.
TDPS Sgt. Kyle Bradford said they apprehended the man on a charge of intoxication manslaughter connected with a fatal four-vehicle collision that occurred two months ago. The accident report disclosed that on April 16th, Fain, while driving a pickup truck westbound on State Highway 276, struck an eastbound vehicle attempting to turn into a driveway.

The sergeant said that the suspect then spun off and hit two other vehicles. Fain as of Wednesday morning, June 17th, was remanded in the Hunt County Detention Center in place of a $250 000 bail bond. There is no information on the date of his arraignment.
Intoxication manslaughter is a severe offence in Texas, and prosecutors try it as a second-degree felony. A conviction means a prison sentence of two to twenty years and an optional fine of at most $10,000.
To secure a conviction, the prosecution must prove that the offender drove a vehicle in a public place, operated an aircraft, watercraft, or an amusement ride, while intoxicated, and accidentally killed a person in that state.
