Osorio collided head-on with the pickup truck of a 21-year-old man. The young man sustained severe injuries and passed away at the scene. The police withheld his identity pending the notification of the next-of-kin.
The doctor went away from the accident with minor injuries and refused to accept treatment at the hospital. The police at the scene determined Osorio was driving under the influence and arrested him. He is facing a charge of intoxication manslaughter.
The police said that officials at Methodist Health System confirmed that the suspect was a contract hospitalist with the Cardiology Clinic of San Antonio. There is no additional information at this time.
Intoxication manslaughter under Texas law is different from the “Regular” manslaughter and vehicular manslaughter, which requires proof of reckless act or reckless driving. During the trial, the prosecutors must prove that the intoxication of the driver led to the death of the victim.
The proof is beyond a reasonable doubt, and a convicted person faces between two to ten years imprisonment, and up to $10 000 fine. Those involved in this kind of accident should contact a drunk driving attorney.
