Preliminary reports suggested the victim was walking on the roadside, in the westbound lanes of Curtner, when an approaching 2000 Dodge Caravan ran her over. The operator of the vehicle, identified as Esfandier Nikbakhshtali, 76, of Santa Clara fled the scene of the collision, leaving the struck woman critically injured.
First responders transported Bernard to a local hospital, where medical personnel confirmed her deceased. According to the reports, San Jose police officers later tracked down the driver and arrested him in his Santa Clara residence.
Investigators believe the suspect was driving while intoxicated at the time of the traffic collision. They booked him into the Santa Clara County Jail on suspicion of driving under the influence, hit-and-run, and possession of the illicit substance, paraphernalia.
Victims of traffic collisions or their families can contact a top accident lawyer for representation, should they choose to pursue a lawsuit using an injury, or a wrongful death claim.
