The CHP revealed in the preliminary accident report that the Montebello resident was driving a 2017 Honda Accord when his front left tire went flat. Gilpineda stopped in between the third and fourth lanes of the freeway and stepped out of his car.
The man was still standing on the roadway, when a 2018 Honda Civic crashed into the parked vehicle, and struck the deceased. Gilpineda sustained severe injuries, and according to the Los Angeles County Coroner’s Office, he died at the scene.
The authorities did not release any information on the identity of the Honda driver or whether or not he was cited. The accident remains under investigation. The CHP has asked anyone with relevant information to contact their Baldwin Park office.
When accidents occur, several legal issues arise depending on the circumstances of each case. They are mostly criminal or civil, and sometimes, it is both. The criminal case is handled by the District Attorney’s Office, while individuals institute a civil action.
In either case, those involved in an accident should contact a top accident lawyer to advise them of their legal rights.
