The police officials disclosed that the Accord’s unidentified 37-year-old driver drove into the path of a Chevy Tahoe driven by Atkinson, causing the collision. The younger motorist sustained fatal wounds that he succumbed to at an undisclosed location. The authorities will release the deceased’s name once they notify the next-of-kin.
The investigators determined that alcohol and speed played a role in the accident and arrested Atkinson on suspicion of driving under the influence. They placed him in the West Valley Detention Center in place of a $100 000 bail, and as of Monday evening, he was still there.
The SBPD is keeping the investigation open, and they asked witnesses to come forward and give their statements if they haven’t.
Under California law, a driver should have below .08% blood alcohol content when driving. Anything from that number is a traffic violation settleable with a fine. When it involves a fatal accident, the offending driver would need a drunk driving attorney to represent his or her interest.
