The Stockton Police Department on August 19, arrested a 21-year-old man in the Stockton area of California. Police charged the suspect, Nicholas Englesby, with elder abuse stemming from a Wednesday afternoon confrontation.
At about 1:30 p.m., police in Stockton received a 911 call reporting the assault of an elderly citizen on the 6800 block of Annapolis Quay Circle. The officers showed up at the location of the reported disturbance to investigate the source.

They found Englesby in the area and determined he was the culprit. However, when the lawmen attempted to take the suspect into custody, he resisted and made attempts to flee the scene. As a result, Stockton police officers restrained him on the ground and put him under arrest on two charges. The suspect’s charges include a count each of elder abuse and resisting arrest.
Resisting arrest is a misdemeanor charge, which attracts up to a year sentence in a county jail, in addition to the stipulated bail agreement. The penalty for elder abuse, however, is less definite, due to the varying forms of elder abuse.
The California Penal Code describes an elder as someone, male or female, who is 65 years and older. This group comprises vulnerable seniors, often left in nursing homes or assigned to caregivers as a result of diminishing bodily functions from aging.
Any act of felony or misdemeanor committed against an elder can pass for elder abuse in court, including neglect, physical/mental/emotional abuse, theft, or swindling. The penalty attached to this crime depends on the nature of abuse dealt the elder.
