When an accident occurs, the degree of liability a person gets is dependent on how negligent he or she behaved. The investigators look at sole or contributory negligence to determine the charge to recommend to the prosecutors.
During trial, the court would use the degree of negligence to determine the punishment an offender deserves and the compensation to award to the victim. Those involved in this kind of accident should contact a motorcycle attorney.
