They were walking in Buster Chatham Road’s 2000 block in the area of Angle Lane when the crash occurred around 9 p.m.
Early information suggested that the accident was a hit-and-run.
However, on Tuesday, the Texas Department of Public Safety said otherwise.
Sgt. Ryan Howard said further investigations revealed that the driver came back to the scene. He said that as a result of the investigation, no charges would be filed.
However, Cunningham’s family is disputing this account of events. They don’t believe the individual stopped to offer help.
Cunningham’s son Andrew said his brother Sam was first on the scene and he stayed with their mother until she was taken to hospital.
Andrew said the driver didn’t return during that time and deputies at the scene were not aware of this happening.
The identity of the driver has not been made public.
Cunningham and Bench received medical attention at Baylor Scott & White Hillcrest Medical Center.
Cunningham was treated and discharged while Bench remains in serious condition in the hospital’s Intensive Care Unit.
The two women have the right to seek compensation from the driver with help from a top accident lawyer.
More clarity could be provided if the authorities publish additional accident reports.
