According to the Illinois State Police, Powers operated a black Toyota south on Mill Street. It traveled off the roadway to the right for unknown reasons and struck two trees. The impact ejected the man, who was not wearing a seatbelt, from the vehicle.
The police said a passenger in the Toyota, identified as Justin W. Clark, 33, of Martinsville, survived with non-life-threatening injuries. Medics airlifted him to an area hospital for treatment. There is no additional information.
Under the California Vehicle Code 27315 VC, any person 16 years and older must wear a seat belt when driving a car or riding as a passenger. Car owners must maintain the safety belts in good working order, and a violator is liable to pay $20 for the first offense.
The law requires the offender to pay a fine of $50 for every subsequent offense. The actual fine the driver would receive is significantly more than the base fine, as it includes other fees and penalty assessments. The court can also order the person to attend a traffic school.
