A boating accident in the Lake Camanche area of Amador County, California, killed one woman and led to the boat operator’s arrest. On Monday, September 7th, county officials said in a press release that Jose Manuel Gil, 33, of Livingston was impaired when the vessel crashed.
The incident happened at about 9 p.m. on Sunday, September 6th, amid the Labor Day weekend celebrations. The accident report disclosed that the boat carried eight people, including two children.

The Amador County Sheriff’s Office said that a woman died in the accident, and the other occupants sustained unspecified injuries. Deputies arrested Gil on charges of manslaughter, boating under the influence, child cruelty, and false identification.
The sheriff’s office remanded him in place of a $10 000 bail bond. There is no additional information at this time.
The Harbors and Navigation Code 655 is the California statute that defines boating under the influence. Under the section, it is a crime for a person to operate any boat, watercraft, jetski, or vessel while under the influence of drugs or alcohol or with a .08% or higher blood alcohol concentration.
Those operating a commercial vessel must have below .04% BAC. It is also an offense to commit a negligent act that causes bodily injury to another person while boating under the influence.
Prosecutors charge the offense as a misdemeanor or felony, and the penalties vary depending on the section of the law the offender violated. The standard misdemeanor punishment carries a jail sentence of six months to one year and fines up to $1,000. The felony punishment covers 16 months, 2, or 3 years imprisonment.
