The move caused him to collide with an oncoming 2018 Freightliner tractor driven by Casas. The impact of the collision caused the rear-axle of the trailer to shear off completely. The vehicle then continued across the westbound lane into the north shoulder before it rested.
Padilla sustained non-life-threatening injuries, the California Highway Patrol said. The man received treatment at the scene, and Casas was relatively unhurt, and only complained of pain.
The wreckage from the collision caused the authorities to close Highway 46 while they cleaned the debris and concluded preliminary investigations. The CHP did not state if Padilla will get cited, and they are still investigating.
Under California law, Casas can bring a personal injury action against the driver whose actions caused the accident. During the trial, he would have to prove that Padilla was negligent, and he suffered an injury or loss because of it.
