The BPD said that at about 3:45 a.m., Pearson, driving an Audi hit a Toyota driven by the deceased man. The two vehicles were driving west on the East Panama Lane. The impact of the collision caused the Toyota to roll over, and the driver died from the injuries sustained.
The BPD did not state whether Pearson was injured or not. But they arrested him on suspicion of driving under the influence resulting in death and gross vehicular manslaughter. Both offenses are criminal and punishable with jail time upon conviction.
Under California law, the driver involved will lose his or her driving privileges until a time decided by the court to lift it. Before convicting an impaired driver, the court would consider certain factors to prove negligence.
The factors include the driver was driving a vehicle at the time of the accident and that the driver was under the influence of drugs or alcohol at the time. That the person committed an illegal act, and the commission led to the death of another or severe bodily injury.
Those involved in a DUI accident should employ the services of a drunk driving attorney.
