Based on witness statements and police investigation at the scene, they determined the driver of the accident was drunk at the time.

The driver was later identified as 32-year-old Cirilo Martinez Tellez. The suspect took off on foot after the accident.

The child was taken to the hospital but was pronounced dead shortly after his arrival there.

Four hours later, Tellez showed back up at the scene of the accident. He was arrested by the Fairfield Police Department.

Information soon became available that Tellez is the victim’s uncle. There were no other injuries reported regarding the accident.

After being arrested, Tellez was taken to the Solano County Jail. He is currently being charged with vehicular manslaughter and felony hit-and-run causing death.

The Fairfield Police Department plans on meeting with the local county district attorney regarding the accident case. They want to have the district attorney consider possible charges that include murder, felony DUI causing death, and violation of probation.

Felony hit-and-run causing death is a possible 3 years incarceration and a $10,000 fine.

The district attorney could move to up the charge to a felony DUI offense due to the death of Tellez’s nephew.

The probation violation indicates that Tellez has had trouble with the law in the past and it could serve as a harsher punishment depending on his prior arrests. If it was for a DUI, chances are he could be looking at up to 10 years in prison.

The police are still investigating the accident and are scheduled to meet with the district attorney to discuss the case in the near future.
