The investigators said that the two vehicles collided head-on around 6:30 a.m., leaving the victim injured. Responding medics transported Romayor to the hospital where he died while undergoing treatment.
DeLuna suffered minor injuries, including a laceration to his right hand, and the medics treated him at the scene. Officers determined that he drove while under the influence, and arrested him on suspicion of vehicular manslaughter while intoxicated, DUI causing injury, and DUI with a blood-alcohol level of more than .08%.
Driving under the influence of drugs or alcohol is a severe offense in California and carries stringent punishments. The California Vehicle Code provides that operators of motor vehicles must drive with less than .08% blood alcohol concentration.
Drivers of commercial vehicles and school buses must have below .04% BAC, while young people below 21 years must have less than .01% BAC. This rule contravention means possible imprisonment, fines, administrative driver’s license suspension, and compulsory alcohol reeducation program.
