The Audi for unknown reasons struck the Toyota from behind, causing it to go off the roadway and slam into a telephone pole. The vehicle rolled over several times and ended up catching fire with Gonzalez inside. The paramedics pronounced the man dead at the scene.
Officers reported the wreck at about 3:46 a.m. and determined that Pearson was under the influence. A field breathalyzer test revealed that the young man had a 0.18 percent blood alcohol concentration. The number is twice the legal limit of not more than .08 percent.
The accident report also showed that the officers arrested the male driver on charges of DUI resulting in death and gross vehicular manslaughter. The latter is a felony under California law, and the court in convicting the suspect would look at some factors.
They include that the offender drove a vehicle and was intoxicated when behind the wheel. They will also look at the fact he or she caused bodily harm or the death of another while in that state. A vehicular manslaughter conviction resulting from DUI carries between two to ten years imprisonment.
