Timmy Brodigan is bringing forth a lawsuit against three agencies responsible for an Amtrak accident he was a victim in. The National Transportation Safety Board found Amtrak, Sound Transit, and the Washington State Department of Transportation responsible for an accident that occurred December 18, 2017.
Since that day, Timmy Brodigan’s life has never been the same. Brodigan was taking the Amtrak train that was making its first run on the Point Defiance Bypass. The route that was supposed to take ten minutes off of a commute, took the lives of three and injured dozens more.

Timmy Brodigan was one of those who was injured in the accident. He ended up with a broken neck that has left him paralyzed since that day. Based on the medical reports, he had to have hit his head extremely hard to crush his C5 vertebrae as he did.
He has been in therapy to try to regain his movement. He has even moved to Colorado to go to a hospital that is known for its renowned treatment of spinal cord injuries.
The lawsuit focuses on the negligence of all three agencies. The driver of the train had only made one round trip on that line prior to the accident. The lawyer for Brodigan is emphasizing that when there are 77 people on a train that is traveling 80 miles per hour, it should never be used as a learning experience.
The train was supposed to take a curve in the track at about 30 miles per hour, but the driver of the train had taken his eyes from the track for all of 20 seconds. They hit the curve at the same speed they had been traveling and derailed.
The train left the track and plummeted onto the I-5.
Brodigan’s life has been a nightmare ever since. He is confined to a wheelchair. He was once an athletic teen.
Three lawsuits previously filed were awarded $17 million.
