The girl was riding on the handlebars of the bicycle when a Dodge Dart struck them as they crossed Thunderbird. The collision’s impact threw the victims from the bike, and they sustained fatal wounds. The police said that the female driver involved stayed at the scene and cooperated with the investigation.
The GPD is considering the possibility of intoxication or a medical issue being factors in the crash. They have not filed any charge, but it might change pending the outcome of their investigation.
When an accident occurs, the investigating authority looks at the events leading to the crash to determine liability on the side of the presumed offender or the victim. If they find any form of negligence on the part of the victim, then the suspect can use contributory negligence as his or her defense.
Contributory negligence will either get an offender an acquittal or a reduced sentence. If there’s no evidence of negligence on the part of the victim, then the suspect, if convicted, will serve the full punishment of his or her offense, or a reasonable sentence determined by the court.
