Texas Department of Public Safety was called to an accident in Scurry County early Monday, January 28. The accident occurred on South Highway 208 about a mile from Dunn.
Based on the information provided in the initial accident report, Cody Allen Loving, a 45-year-old man from Snyder, was the driver of the first truck. Loving’s Ford truck was traveling eastbound when he failed to stop at an intersection. When he went through it, he crashed into the driver’s side door of another Ford truck.

The other Ford truck was traveling northbound and was being driven by Jared Lee Foster, a 39-year-old man of Colorado City. Due to the extent of Foster’s injuries, he was pronounced dead at the scene of the accident. His body was then transported to Bell-Cyper-Seale Funeral Home according to the Texas Department of Public Safety.
Loving, who was only injured after causing the accident, was transported to University Medical Center for treatment of his injuries.
Both men were wearing their seatbelts at the time of the collision. The accident is still being investigated at this time.

Vehicular manslaughter is when a driver causes the death of another person in an accident because of their reckless driving. Vehicular manslaughter is a second-degree felony in Texas, and it can carry a hefty prison term. Someone convicted of vehicular manslaughter could see up to 20 years in prison.
There is still a chance that the charge could be downgraded to negligent homicide. This is when it is proven that someone was criminally negligent in the way that they were driving their car when the accident occurred. The prison sentence in a negligent homicide is lighter than in a vehicular manslaughter case. The prison term could be up to two years, but it is still a felony that would go on the permanent record of the driver.
At this time, there have been no formal charges filed against Loving.
