The report disclosed that the man stood beside his tow truck when the suspect’s SUV struck him. The CHP said drugs or alcohol might have factored in the accident. The victim died at the scene, and medics treated Miller for minor injuries.
Afterward, officers placed him under arrest for driving under the influence of drugs; he would need a car injury lawyer. Sergeant Michael Phillips advised drivers to avoid stopping on the freeway for any reason to prevent accidents of this nature unless it is an emergency stop.
The investigation into the occurrence is ongoing. Anyone with credible information can contact the highway patrol.
Under the California Vehicle Code, a person drives under the influence of drugs when they can no longer operate a vehicle like a sober person under similar circumstances. Drugs under this head are illegal chemical compounds, prescription or over-the-counter medications, or a combination of drugs and alcohol.
A misdemeanor charge for DUI carries a penalty of three to five years DUI probation, a fine of about $1,800 for a first offender, and California DUI school. Additionally, the person would face a driver’s license suspension and possible jail time.
