Claire Zisserson, just 13 years old at the time, was killed.
Kendall Zemotel’s father, Gary Zemotel, is suing Goodsell and the company he worked for, Hi-Way Safety Systems, along with owners Kenneth Horn and Kathy DeLong. The lawsuit filed contains accusations that Horn and DeLong distributed alcohol and allowed the use of cocaine at the company party, which Mr. Zemotel is claiming to have caused the crash.
He will try to prove negligence regarding the failure of several people at the company party to prevent Goodsell from driving the company vehicle white under the influence of alcohol and drugs. It is said that the employees were aware of Goodsell’s intoxication. They tried and failed to get his keys, then allowed him to drive away.
In 14 years of being a licensed driver, his driving record shows that Goodsell has been ticketed for speeding 3 times, two violations for failure to stop or yield, and other various infractions. His license has been suspended to protect the safety of the public.
