The 19-year-old driver of the truck exited toward Interstate 10 westbound against what the front seat passenger said. This passenger was trying to supply directions using a GPS.
Amongst the confusion of which way to go, the driver ended up hitting the sand barrels at the highway split. The GMC ended up going over the wall and plummeted 25 feet to the ground.
The GMC ended up landing on the lower level of the highway and rolled several times before coming to a stop.
Flores, who was in the backseat without a seat belt on, was ejected through the back window during the accident. Emergency personnel called the time of death while at the scene.
The driver and the front-seat passenger were taken to University Hospital. The driver was critically injured in the accident.
The front passenger was in stable condition.
Police have determined that the driver was intoxicated during the accident. Upon release from the hospital, they will formally charge him with intoxication manslaughter and possibly other citations.
Intoxication manslaughter is a second-degree felony. This can carry up to a 20-year sentence in prison.
The driver is also an underage drinker. There is a defense to underaged drinking if you are in the presence of a parent or legal guardian, however, a DUI or a DWI can still be charged.
It has not been determined where the three occupants of the GMC were going at that time of night, but an investigation is ongoing.
It has not been made public if Flores and the front seat passenger were intoxicated as well.
