The Kendall County Sheriff’s Office on Thursday night, July 2nd, arrested and charged James Brudnicki, 56, of North Stonewall Drive in Newark, for driving an all-terrain vehicle (ATV) while intoxicated and crashing it. The accident occured in Fox Township, Illinois, and the man would need a drunk driving attorney’s service.

According to the sheriff’s office, they dispatched deputies to the crash site in the 9300-block of Lee Hill Road at approximately 10:49 p.m. The officers said that Brudnicki rolled his ATV while driving under the influence, and sustained non-life-threatening injuries.

The medics transported him to Valley West Hospital for treatment, and afterward, the police arrested him for DUI and cited him for illegal operation of an ATV. They issued him a recognizance bond and released him. There’s no information on his court date.

In Illinois, non-commercial drivers from 21 years and above are legally drunk when their blood alcohol level is .08 or more. Drivers of commercial vehicles, including school bus drivers, are legally intoxicated if their BAC is .04 percent or higher, while private motorists below 21 years are legally drunk if their BAC is more than zero percent.

A person convicted of a DUI is liable to a prison term not exceeding one year and a fine of $2500. A second conviction within five years of the first means mandatory five days in prison or 240 hours of community service. The penalty increases per number of sentences within a specific time frame with the highest being six, a Class X felony that is punishable with 6 to 30 years imprisonment, and up to $25 000 fine.
