Under the California Vehicle Code, a hit-and-offense gets charged either as a misdemeanor or felony. The law states that regardless of who was at fault in an accident, drivers must immediately stop at the scene, provide help to the injured, call 911, and, if necessary, exchange information.
Before a person can get convicted of the offense, the prosecution must prove that the offender got into an accident while driving a vehicle. They must show that the occurrence caused damage to another person or property, the offender knew that he or she caused harm and that the person willfully failed to immediately stop at the scene, provide help, or exchange information.
